holiday autos acts as a car rental broker for various independent rental companies in the countries in which it operates. Bookings made through holiday autos are subjected to the terms and conditions which are mentioned below. Please note that the rental of the vehicle will be subjected to the law of the country in which it is supplied to you and for this reason you will be required to sign a rental contract with the rental company which supplies the vehicle. You must comply with the general conditions as well as the local law.

Reservation

The following information is required to make a booking : the date, time and place of pick-up as well as the date, time and place of drop-off, the car type and the driver’s name, initials and age. The driver must have an internationally accepted credit card in his/her name. When a booking is confirmed, an invoice will be sent in case the booking was made by a travel agency. And in case of a direct client, the rental amount will be debited from the credit card supplied at the time of reservation.

Rates

holiday autos publishes a new brochure, every season, which mentions the rates and conditions. These rates are indicative and imply no obligation for the customer to buy.
The rates mentioned in the brochure can be subjected to change, due to modifications of the general conditions, changes of availability or a changed exchange rate at the time of the reservation. The final rental fee, however, is the one mentioned on the invoice. It is the customer’s responsibility to check this rental fee before departure. The price mentioned is only to be applied to the information mentioned on the voucher, which is guaranteed by holiday autos and for which holiday autos is responsible. It is the responsibility of the travel agent to inform his/her customer that complaints, if any, regarding this rental fee can not be entertained after the rental. Once the rental car is received by the customer no refund can be made if the customer cancells, changes, shortens or extends his or her reservation locally. Any extension should be requested through holiday autos and implies a new reservation at the rate of that moment. If the reservation was made via a travel agency, the extension must also be made via this agency.
No refunds will be made in case the customer fails to produce his car rental voucher, his driver’s license or his credit card.

Price calculation

The rates are based on a week price and are calculated on the basis of 24hr-periods. Announced prices are indicative and are subject to change at any time. The final price is the price displayed at time of confirmation.

Included in the price

Travel Pack :

• unlimited mileage
• legal liability (LL)
• collision damage waiver (CDW) with a remaining excess amount *
• theft protection (TP) waiver with a remaining excess amount *
• all local taxes and airport surcharges (with a few exceptions **)
• the SLI insurance, which will increase the legal liability up to $ 1.000.000

* This remaining excess amount can be waived with the all insurance option.
** These exceptions will be confirmed during reservation.

all insurance option

For an extra 3 euro a day, holiday autos offers you the possibility to waive the remaining excess amount in case of damage, an accident or theft in addition to the "Travel Pack formula". See section " Refund of the excess amount in case of damage to or theft of the rental car".

Not included in the price

The following insurances and/or extra’s can (if available) be offered locally and are payable to the local rental company :

• an optional SDW (super damage waiver, buying off the excess amount in case of damage *)
• an optional STP (super theft protection, buying off the excess amount in case of theft *)
• an optional PAI (personal accident insurance for the driver)
• an optional PERSPRO (personal protection)
• an optional POM (peace of mind; combination of a PAI, SDW and STP)
• an optional PEC ( theft protection for luggage).
• fuel (in case of the gold formula in the USA and Canada a full tank of fuel is included)
• extra’s as childseat, roofrack, snowchains, etc ...
• airport surcharges in certain countries. Please inquire at the time of the booking.
• drop off charges (in case of one way rentals)
• surcharges for young and/or additional drivers. The minimum age in most cases is 21 years. Until the age of 25 there may be a young driver surcharge payable locally. The driver must produce a valid driver’s license, held for at least one year. In certain countries there are more restrictions and there is also a maximum age applicable. It is the responsibility of the customer to mention this information during reservation. Additional drivers must be mentioned on the rental agreement at the time of the pick-up of the rental car.
• pick-up and drop-off of the rental car before or after the normal opening hours of the location can be subjected to additional charges always payable locally.
• deposits via credit card (mandatory, in some countries a cash deposit may be accepted, please check during reservation).
• non- waivable damage as mentioned in the section "no excess amount".

* Already covered by the all insurance option.

The rates for the above items, mentioned during reservation and on the voucher are indicative and can be subjected to change.

Refund of the excess amount in case of damage to or theft of the rental car

This refund can only be applied in case of subscription of the all insurance option during the booking. In case of damage to or theft of the rental car, the excess amount will be charged directly to the customer by the local rental company. The following documents need to be sent to holiday autos within 30 days after returning the vehicle in order to become eligible for a refund of this amount :

• a copy of the rental agreement,
• a copy of the damage report or theft report (these documents are available with the local supplier),
• a copy of the police report in case of an accident with physical damage and/or an unknown second party,
• a copy of the theft-declaration with the local police,
• a proof of debit of the excess amount by the local supplier (e.g. a credit card statement).

After resolving the file (within 30 days after the receipt of all the documents, exceptions not included) possible refunds will be made directly to the customer (deducting possible file and/or immobilization costs).

Exclusions: In the following cases the excess amount will not be refunded and the customer remains financially responsible for all costs :

• if the accident/ damage is caused by a driver who is not mentioned on the rental agreement,
• if the driver doesn’t meet the terms and conditions of the rental agreement (minimum age, driver’s license, etc),
• if the driver is under the influence of alcohol, drugs or medication,
• if the vehicle is driven outside the admissible zones,
• in case of physical damage,
• transport of people in return for payment,
• transport of inflammable, explosive and/or corrosive goods,
• participation in a contest, drive tests and/or driving exams,
• usage of the vehicule to push, pull or tow another vehicule,
• damage caused to the vehicle due to a non-compliance with the maximum allowed weight, width or height,
• driving outside the permitted countries,
• damage to or theft of the rental car due to a specific neglect,
• damage to or theft of the rental car due to an exclusive and or intentional mistake,
• if the key(s) of the rental car were not handed over to the rental company immediately.

Best price guarantee

If the customer finds, before or after reservation (but prior to departure) a cheaper rate for the same categorie of car on the basis of the same conditions with an independent car rental operator in the Benelux, holiday autos will offer a rate that is 1 euro cheaper than this price. The "best price guarantee" does not apply to promotions offered by a supplier at a certain time or place.

Cancellations

By cancellation we mean the cancellation of the car rental by the travel agency for their customer or by the customer himself, prior to departure and the cancellation of the car rental by holiday autos in case of a non-payment of the invoice.

Cancellation charges

Cancellation on the same day as the reservation:

no charge, with exception of "last minute" reservations (reservations with a pick-up time within 24hrs starting from the moment of the reservation).

Cancellation with cancellation waiver protection :

For just 10 euro per rental, holiday autos offers its customers the possibility to protect themselves against cancellation charges. This optional cancellation waiver must be purchased at the time of the booking. In case of a sign-up for the cancellation waiver, the customer can cancel the reservation at any time without any charge.

If no cancellation waiver protection was purchased, the following costs will be applied if the customer wishes to cancel prior to departure :

• More than 31 days before start of the rental : € 0
• From 31 days till 21 days before start of the rental : € 20
• From 20 days till 5 days before start of the rental : € 25
• Less than 5 days before start of the rental : € 50

The above mentioned cancellation charges as well as the price for the optional cancellation waiver are indicative and can be subjected to change. Any reservation made before possible price changes, will not be subjected to these changes.
From the moment the invoice is issued, every cancellation will necessarily imply costs. It is the responsibility of the travel agency to draw the customer’s attention to these cancellation charges.
The cancellation charges will be invoiced to the party who paid for the reservation. If this party is a travel agency it is up to them to pass these charges on to the customer.

No show

If the customer does not present himself at the desk of the local supplier at the fixed time and place, or if he cancels the reservation 4 hours prior to the start of the rental, the rental will be considered as a "no show" and the rental cost will not be refunded by holiday autos. However this does not apply to the client who opted for the cancellation waiver protection.

Reponsibility

The reponsibility of holiday autos

holiday autos guarantees the delivery of the rental car under the conditions mentioned on the voucher : date, time and place of pick-up of the rental car, as well as date, time and place of drop off, type of the rental car (or a similar type), name and initials of the lead driver holding an internationally accepted credit card, the reservation number, name and location of the local rental company, items included in the price, in particular : unlimited mileage, collision damage waiver, theft protection waiver, local taxes (exceptions, who will be confirmed when making the reservation, not included *).
In all cases the responsibility of holiday autos is strictly limited to the rental fee.
All other items appearing on the voucher are indicative and should be validated by the client when signing the rental agreement.

Responsibility of the travel agent

The travel agent has to make sure that his customers have accepted the terms and conditions. It is also his responsibility to pay holiday autos the rental charge, before departure of the customer.
It is the travel agent's task to give the necessary information to holiday autos and in particular the numbers of the flights arriving (for rentals with a pick-up at the airport). When receiving the voucher, the travel agent has to check whether all information is correct. He shall go through this together with the customer before handing over the voucher. holiday autos will not be held re sponsible for problems, caused by supposed incorrect, insufficient or unclear information, mentioned on the voucher, in case the travel agent did not inform holiday autos about this incorrectness or imperfection prior to departure. When handing over the voucher to the customer, the data mentioned on it have to be approved and checked by both the travel agent and the customer.

Responsibility of the customer

The information on the voucher has to be checked before departure. holiday autos will not be held responsible for problems, caused by supposed incorrect, insufficient or unclear information, mentioned on the voucher, in case the customer did not inform holiday autos about this incorrectness or imperfection on the voucher.
It is the customer’s responsibility to read the rental agreement very carefully before signing it, this way making sure he/she only signs for the options he/she wishes to sign up for, apart from the items already included in the rental fee. The items already included are mentioned on the voucher. The items agreed upon and accepted by the customer in accordance with his/her wishes, and signed up for locally when signing the rental agreement, cannot be contested nor lead to any refund by holiday autos afterwards.

Complaints

Any problems regarding invoices have to be passed on to holiday autos immediately after reception of the invoice. All complaints about the rental have to be passed on to the customer relations department of holiday autos via letter, fax or e-mail. These written documents should contain the following data :

• Booking number
• Name of the customer
• Place and date of the rental

A copy of the voucher, the rental agreement and all other documents will speed up/accelerate the handling of complaints.
If a travel agency refunds a customer, without a written permission of holiday autos, holiday autos cannot be held liable for this.

The company which with your contract is formed may depend upon the country in which your car is to be supplied.
